Terms of Service

By accessing or using MyTrendView ("the Service"), provided by [noch nicht hinterlegt] ("we", "us"), you agree to these Terms of Service. If you do not agree, do not use the Service.

MyTrendView is a SaaS platform that analyses publicly available data from social media platforms and produces trend analyses, content recommendations, hooks, scripts, video plans and competitor and creator insights using AI. The exact feature set depends on your plan.

You must be at least 16 years old. You must provide accurate information and keep your credentials confidential. You are responsible for all activity under your account.

MyTrendView offers a free plan and paid plans. Prices are shown in EUR including statutory VAT for consumers in Germany / the EU. Paid plans are billed monthly or annually as selected, in advance, by credit/debit card or SEPA Direct Debit. Invoices are provided electronically.

This service starts immediately at your express request. If you agree to that at checkout, your right of withdrawal ends as soon as we have fully provided the service.

Right of withdrawal
You generally have the right to withdraw from this contract within fourteen days without giving a reason. The period is fourteen days from the day the contract is concluded.

To exercise it, inform us by an unequivocal statement (e.g. a letter or an email to legal@mytrendview.com). Sending the notice before the deadline is enough to meet it. You may use the model withdrawal form, but you do not have to.

Early expiry of the right (§ 356 (5) BGB)
MyTrendView is a digital service available immediately after the contract is concluded. That is why we ask for your express consent before every payment. Ticking that box confirms two things:
- that we should begin providing the service before the withdrawal period ends, and
- that you understand you thereby lose your right of withdrawal once the service has been fully provided.

Without that tick no paid contract is formed. Your consent is recorded with its timestamp and exact wording, and a copy reaches you with the contract confirmation by email (§ 312f (3) BGB).

Effects of withdrawal
If you withdraw effectively — that is, before the service has been fully provided — we refund all payments received without undue delay and at the latest within fourteen days of receiving your notice, using the same means of payment. For the part already used we may charge proportionate compensation (§ 357 (8) BGB).

No right of withdrawal for businesses
This notice applies to consumers within the meaning of § 13 BGB only. If you enter into the contract in the course of your trade, business or profession, there is no statutory right of withdrawal.

You must not:
- use the Service to violate law or third-party rights, including platform terms (e.g. YouTube ToS, Instagram ToS),
- attempt to reverse-engineer or compromise the Service,
- scrape MyTrendView for competing offerings,
- share credentials, or
- upload illegal, infringing or harmful content. We may suspend or terminate accounts that breach these rules.

You may create API keys to use the Service programmatically, including through our MCP server.

Your key is your responsibility. It authenticates as you. Keep it secret, never commit it to a repository, and revoke it immediately if it may have been exposed. Calls made with your key count as your calls, including the tokens they consume.

Token charges. Tools that consume MTV tokens quote their price first and only run when the call is repeated with that quote. This confirmation step exists so an automated caller cannot spend your balance without the cost being surfaced. If you build automation that confirms quotes without showing them to a human, the resulting charges are still yours.

Fair use. We may rate-limit, suspend or revoke a key that degrades the Service for others, circumvents plan limits, or is used to resell access to the Service as a standalone product.

No warranty of interface stability. The API and the tool set may change as the product develops. We will avoid breaking changes where we reasonably can, but the API is not a frozen interface.

The Service, including design, code and brand, is owned by [noch nicht hinterlegt]. AI-generated outputs (plans, hooks, scripts, images, captions) that you create through your account are yours to use, subject to applicable third-party rights and the terms of the underlying model providers. You grant us a limited, non-exclusive license to process your input data solely to provide the Service.

AI outputs are suggestions. You are responsible for reviewing and editing them before publication. We do not warrant the accuracy, originality, non-infringement or legal compliance of AI-generated content.

The Service integrates third-party APIs (e.g. YouTube, Google, Anthropic, Apify, Cloudinary, Vercel). Your use of those integrations is also subject to their respective terms. We are not responsible for outages or changes of third-party services.

We are liable without limitation for damages caused by intent or gross negligence. For slight negligence we are only liable for breach of a material contractual obligation ("Kardinalpflicht") and the liability is limited to typical, foreseeable damage. Liability under the German Product Liability Act and for injury to life, body or health remains unaffected.

You may cancel at any time. Monthly plans end at the end of the current billing cycle. Annual plans are pro-rated within the 14-day withdrawal window. We may terminate or suspend accounts for material breach. After termination we retain your data for 30 days for reactivation, then delete it (statutory retention excepted).

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN CISG. For business customers (B2B) the exclusive place of jurisdiction is Berlin. Consumers retain the protections of the mandatory laws of their country of residence under Art. 6 Rome I Regulation.

The European Commission provides a platform for online dispute resolution under ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute-resolution proceedings before a consumer arbitration board (§ 36 VSBG).

We may change these Terms; material changes will be announced at least 30 days in advance by email. If you do not agree, you may terminate before the change takes effect.
